Introduction

This privacy notice relates to AdviceRights T/A Warwickshire Employment Rights Service and it applies to any information provided to us by post, email, telephone or at face to face interviews and any information provided via our website.

We collect and use the personal information provided to help solve your employment law problems, improve our service and to help address wider issues in society.

We only ask for the information we need and we will explain to you why we need it and will treat it as being confidential.

Any personal information you provide to us will not be sold or traded to third parties and we will only access it when we have a good reason to do so and will only share what is necessary and relevant.

In some circumstances we may need to disclose your personal information to:

  • A third party to provide a service you have requested

  • To fulfil a request for information

  • To comply with a legal requirement or request from a competent court, regulator or authority

We may use the personal information we collect to send you information about our services by email.  You may opt out of receiving any information about our services by sending us an email at enquiries@warksemprights.com

Who is the Data Controller?

We will store the data and restrict access according to our data security policies.

 

Personal data

We will only ask for information that is relevant to your problem and the amount of data that we will require will depend upon the level of assistance you need and whether or not you become a ‘Full Client.’

The personal data we would like to collect from you is the information that we ask from you during the process.

This might include but is not limited to the following:

  • Name and contact details

  • Personal information for example about who you work for, your salary, any relevant medical conditions

  • Details in relation to the issues that are causing you problems at work

  • Information relevant to your case including, gender, ethnicity or sexual orientation

If you do not want to give us certain information, you do not have to and if you want to stay anonymous we will only record information about your problem and will ensure that you are not identified.

If you became a ‘Full Client’ and casework is carried out then you will not be able to remain anonymous due to the level of work that would need to be carried out.

Please note that If you do not provide the information we ask for we may not be able to provide the service that you need.

 

How we use the information

The main reason we ask for your information will be to help solve your problem.

We may also use this information for:

  • Training and quality purposes

  • To investigate complaints

  • To get feedback from you about our service

  • To help to improve our services

We also use some information to create statistics about who we are helping and what problems are the most common.  This information is always anonymised and you cannot be identified.

We may share this information with funders, regulators, government departments, in reports, on social media and in press releases.

 

Using information without permission

In most cases, we will get your permission to collect, use, store and share your information.

However, at times we may use or share your information without your permission.  Where this happens, we will ensure that there is a legal basis for it.

This could include but is not limited to the following situations:

  • To comply with the law (Legal Obligation) – for example, if a court orders us to share information

  • To protect someone’s life (Vital Interest) – for example, sharing information with a paramedic if a client became unwell during an appointment

  • To carry out the aims and goals of the organisation (Legitimate Interest) – to create anonymous case studies and statistics for our research

  • To defend our legal rights – for example, to resolve a complaint

 

Retention period

AdviceRights T/A Warwickshire Employment Rights Service will process personal data for the period it takes to provide you with the service that you have requested or for as long as we are legally required to keep this information.

For example, if you have become a ‘Full Client’ we will store your data for a period of six years after your file has closed.

 

Contact us about your data

You can contact us at any time and ask us:

  • What information we have stored about you

  • To change or update your details or to amend any data that is inaccurate or incomplete

  • In certain circumstances you can ask for the data we hold about you to be deleted

  • To object to certain type of processing such as direct marketing

We may refer any request you may make using these rights to another organisation, if they have been involved in processing your personal data.

Complaints
If you are unhappy about how we are handling your personal data you can complain to the Data Protection Officer. You can also complain to the Information Commissioner’s Office.
